Alienation of Land
Alienation of land means a transfer of land into ownership of other person by means of concluding a contract of purchase and sale, exchange and gift between the parties to the contract. Alienation of land sites is a very popular procedure in Ukraine.
When making any civil transaction, the parties always wish to get a maximum benefit for themselves, namely: to sell at the best price having paid minimum taxes at that. Talking about land alienation and considering that land prices are high, it is rather hard to make oneself pay to the state an obligatory charge to such an extent.
When alienating land, many citizens prefer to conclude a contract of gift instead of the purchase and sale contract for a land site because the fiscal charges are considerably less in case of such transaction. Here exist its own pros and cons as in case the contract of gift is held invalid in future due to some reason, it will be practically impossible to prove the fact of funds transfer. Bear in mind that it is just one of bad consequences which, in fact, are many. Forewarned, forearmed!
