Privatisation of a Land Site
Privatization of a land site means a process of a transfer of the state land in private ownership. Free use of a land site suggests that such site should be made private or the rights for this land site should be registered by the state. The Land Code of Ukraine is the main regulatory act that describes the land site privatization procedure.
Privatization of a land site is a rather complex and multiple-stage process. If you are a user of the land plot being a participant of the garden (summer cottage) partnership or cooperative, then the privatization of the plot is an obligatory step required to preserve your land plot. Just being a member of the cooperative or a partnership and paying membership fees is not sufficient. A land user can be expelled from the cooperative at any time for noncompliance with obligations and, consequently, can be deprived of the allocated land plot.
Privatization of a land plot making a part of the partnership or cooperative is a guarantee that nobody will ever take away your plot from you. Same as privatization of a garden plot, the privatization of a summer cottage plot has its peculiar feature – namely the necessity that you use the land in accordance with its designated use.
In compliance with Art.19 of the Land Code of Ukraine, lands are subdivided according to the designated use into the following categories: agricultural lands; housing and municipal development lands; natural reserves and other environment-oriented lands; health improvement areas; recreational lands; lands of historical and cultural value; forest fund lands; state water fund lands; lands of industrial, transport, communications, power engineering, defense and other purposes.
Thus, privatization of a summer cottage plot means that it is recreational lands that are allocated to private ownership as the summer cottage is intended for meeting requirements in recreation, medication, etc.
Privatization of a Land Site in 2013
As of January 2013, the privatization process ends with issuance of the certificate of the right of ownership to the privatized land site instead of the traditional State Act.
